$150,000 Settlement Approved in Cruise Ship Toddler Death Case

Federal Appeals Court Revives Lawsuit

An $150,000 settlement has been approved in the case of a toddler girl who fell to her death out of a Royal Caribbean cruise ship window in 2019. The 11th Circuit Court of Appeals revived the lawsuit in July 2023.

In July 2021, Salvatore Sam Anello filed a lawsuit against Royal Caribbean on behalf of his 18-month-old granddaughter. The lawsuit alleged that the cruise line was negligent in failing to provide adequate safety measures to prevent the child from falling out of the window.

The district court dismissed the lawsuit, but the 11th Circuit Court of Appeals reversed the dismissal. The appeals court ruled that there was sufficient evidence to support the allegations of negligence and that the lawsuit should be allowed to proceed.

The settlement was approved by the district court on July 12, 2023. The settlement includes $150,000 in damages and $100,000 in attorney's fees.

The family of the toddler said they were pleased with the settlement but that it would never bring back their daughter. They said they hoped the settlement would help prevent similar tragedies from happening in the future.
