Court Docs: Grandfather Saw Open Window Before Granddaughter's Fatal Fall From Royal Cruise Ship

Court documents filed in the family's lawsuit against the cruise line show that the grandfather saw the open window before his granddaughter fell out of it.

The family’s attorney says in the court filing that the grandfather "bears some responsibility" for the child's tragic death and does not contest that the cruise line was negligent.

The parents of Chloe Wiegand, who fell to her death from an open window on a Royal Caribbean cruise ship in 2019, filed a wrongful death lawsuit against the cruise line. The lawsuit alleges that Royal Caribbean was negligent in not having a warning sign on the window or a screen to prevent a child from falling out.

Court documents filed in the case include surveillance video that shows the moments before Chloe's fall. The video shows Chloe's grandfather holding her up to the window, and then her falling out of the window. The grandfather told investigators that he did not see the window was open, but the court documents show that he did.

The grandfather's attorney says in the court filing that the grandfather "bears some responsibility" for Chloe's death. The attorney says that the grandfather "should have been more careful" and that he "failed to take reasonable steps to prevent Chloe from falling out of the window." The attorney also says that the grandfather does not contest that Royal Caribbean was negligent.

The case is currently ongoing. A trial date has not yet been set.
